These terms explain how the Savvy FSBO marketplace works, what we promise, what we do not, and how sellers and licensed agents are expected to interact on the platform. Read them carefully. They govern every listing, inquiry, and subscription.
Savvy FSBO, Inc. (“Savvy”, “we”, “us”, or “our”) is a Delaware corporation with its principal place of business at 1200 Brickell Avenue, Suite 1950, Miami, Florida 33131. We operate a real-estate marketing and matchmaking platform accessible at savvyfsbo.com and related subdomains (the “Platform”).
We are not a licensed real estate brokerage. We do not represent buyers or sellers in a real-estate transaction, do not act as a transaction broker under Florida law (Fla. Stat. § 475.278), and do not receive compensation from the sale of any property listed on the Platform. Compensation to licensed real-estate professionals, if any, is agreed directly between that professional and the party engaging them.
By creating an account, listing a property, subscribing as an agent, or otherwise using the Platform, you agree to these Terms of Service (“Terms”), our Privacy Policy, and any supplementary rules posted on the Platform. If you do not agree, do not use the Platform.
You must be at least 18 years old, legally capable of entering into a contract, and — if listing property — the lawful owner of the residence (or an authorized agent of the owner with written consent).
Listing a property on Savvy is free for homeowners. By publishing a listing you represent and warrant that (a) you have the legal right to market the property for sale, (b) the information you provide is accurate to the best of your knowledge, and (c) all photographs, renderings, and descriptions you upload are yours to use or you have obtained the necessary rights.
Florida law requires sellers to disclose facts materially affecting the value of the property that are not readily observable (Johnson v. Davis, 480 So. 2d 625 (Fla. 1985)). Savvy provides template disclosure forms as a convenience; you are solely responsible for completing them accurately and delivering them to prospective buyers. We strongly recommend reviewing any disclosure with a Florida-licensed real-estate attorney prior to closing.
You may unpublish or delete your listing at any time from your dashboard. Savvy retains a log of listing metadata for up to 24 months after deletion for fraud-prevention and audit purposes, as described in our Privacy Policy.
Agent subscriptions are available to individuals who hold a current, active Florida real-estate sales-associate or broker license in good standing with the Florida Real Estate Commission (FREC). Subscriptions are billed at $79 per calendar week, inclusive of Florida sales tax where applicable, beginning at the conclusion of the complimentary 14-day introductory period.
You may cancel at any time. Cancellation takes effect at the end of the then-current billing period; we do not pro-rate partial weeks. We reserve the right to suspend or terminate an agent account for license lapses, repeated conduct complaints, misrepresentation, or violation of these Terms, with a refund of any pre-paid, unused weekly fee.
You agree not to use the Platform to: (a) harass, defraud, or mislead any other user; (b) scrape, cache, or republish listing data without our written permission; (c) circumvent the inquiry inbox to obtain a homeowner’s contact information before it is voluntarily shared; (d) violate the federal Fair Housing Act, the Florida Civil Rights Act, or any other anti-discrimination law; or (e) list property you do not have the right to market.
We moderate aggressively. Messages containing hate speech, slurs, threats, or solicitations unrelated to a bona fide real-estate inquiry will be removed, and the sender’s account may be terminated without notice.
The Platform’s code, design, copy, AI-generated listing narratives, and branding are the exclusive property of Savvy. You retain ownership of the photographs, floor plans, and original descriptions you upload, and you grant Savvy a non-exclusive, worldwide, royalty-free license to display, reformat, and syndicate that content for the purpose of marketing your listing during its active period and up to 90 days thereafter.
Listing narratives, headlines, image enhancements, and neighborhood briefs generated by our AI systems are drafts. You are responsible for reviewing, correcting, and approving any AI-generated content before publication. Savvy does not guarantee the accuracy of AI-generated text, including but not limited to square footage, school-district assignments, flood-zone data, or HOA information, all of which you must verify independently.
Savvy does not represent you in any real-estate transaction. We do not owe you the statutory duties of a transaction broker or single agent under Florida law. We do not negotiate, prepare purchase contracts, or handle escrow. You are encouraged to engage a Florida-licensed real-estate attorney, title company, or transaction broker to manage the closing process.
Savvy complies with the federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and the Florida Fair Housing Act (Fla. Stat. ch. 760). Listings and inquiries that express or imply preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, national origin, age, pregnancy, or any other protected class are prohibited and will be removed.
The Platform is provided on an “as is” and “as available” basis. Savvy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings will result in a sale, that agents who inquire will bring a qualified buyer, or that any price, photograph, or description on the Platform is accurate.
To the maximum extent permitted by law, Savvy’s aggregate liability to you for any claim arising out of or relating to the Platform shall not exceed the greater of (a) one hundred U.S. dollars or (b) the amount you paid to Savvy in the six months preceding the claim. In no event shall Savvy be liable for indirect, incidental, consequential, or punitive damages.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.
We may revise these Terms from time to time. Material changes will be announced via email to the account on file and posted on this page with a revised “last updated” date. Continued use of the Platform after a revision takes effect constitutes acceptance of the revised Terms.
